Terms and Conditions
This site is operated by Gryphon Holdings, LLC, a Delaware corporation. Your flight will be operated by carriers licensed to operate in the specific areas of departure and landing ("Carrier"). In respect of any charter air service your contract is with the supplier of such service(s), who shall be Gryphon Holdings. Such Carrier's standard conditions may limit or exclude liability, and such conditions, together with the Conditions of Carriage (defined below), and the terms and conditions set out on this web site (collectively the "Conditions of Contract") shall apply to your agreement with us and any designated Carrier. We do not accept any responsibility for the service supplied by any supplier or Carrier, and make no representation or warranty in respect of the products or services featured on this site.
Any reference to 'us' or 'we', shall be deemed to be the party with whom you are contracting, as set out in the 'Legal Information' section.
All bookings shall be subject to conditions and charges for any booking changes. In all cases where a person makes a booking on behalf of others, such person shall:
- Be responsible for ensuring the accuracy of the personal details or any other information supplied in respect of any other passenger traveling on such booking;
- Be responsible for passing on any information regarding the booking or any changes made in relation thereto, to all passengers traveling on such booking, including but not limited to information on schedule changes or copies of booking confirmations;
- Accept the terms of the Booking Conditions and the Conditions of Carriage on behalf of all passengers traveling on such booking;
- Accept on behalf of any person traveling on such booking any refund which may become due from us and we shall refund or otherwise account for such amount to such person, as soon as reasonably practicable, after receiving such refund from the Carrier.
We are entitled to rely on the authority of the person making the booking to act on behalf of the other passengers on such booking.
In the event that any subsequent changes require to be made to a group booking, or in respect to any element thereof, such change shall solely be effected by the person having made the original booking and who is identified as being the "lead passenger" or "booking agent" on the booking system.
These Conditions of Contract do not affect your statutory rights and we reserve the right to change the booking terms and conditions on this site at any time.
These terms and conditions, together with those contained and referred to on the 'FlyGryphon' web site, constitute the entire agreement and understanding between us and any passenger in relation to their subject matter. If you do not agree to these terms you may not use this site.
Prices
The base prices stated on the initial booking pages are exclusive of applicable taxes and fee charges. Passengers who want to book a return flight should indicate this when entering their flight details. You will then see the corresponding price for each one-way flight, or each sector price in circumstances where a return flight must be purchased. Once all flights have been chosen, the total fare including all known taxes, fees, supplements, insurance and charges will be displayed before your booking is confirmed.
Fare prices are subject to change without notice. Government/GSA fares will only be changed in accordance with our GSA Schedule guidelines. Fare prices may be subject to fuel surcharges as well as any taxes imposed by any governmental agency.
Taxes and Fees
When you make your booking, we will tell you of all the taxes, fees and charges, which we are aware of that will apply to your fare at the time of booking. Taxes, fees and charges change constantly and may be imposed or changed after the date that we have issued the Booking Confirmation to you. You will be required to pay any increases in such taxes, fees and charges, and similarly, if any taxes, fees and charges you have paid to us are reduced or abolished, you will be entitled to claim a refund. Such right shall not apply in respect of any surcharge paid in respect of aviation fuel costs. Certain departure taxes or airport levies, may not be shown on your Booking Confirmation, and may be levied at certain international airports. You should ensure you have adequate funds for these taxes which are payable locally.
Payment
Full payment is required as soon as you confirm your booking. Payment is by credit card only.
Payment by credit card may attract a transaction fee, the amount of which (if applicable) will be displayed in the booking summary, before you are asked to confirm your booking.
All fares are listed as whether they are refundable or non-refundable, subject to availability, as well as the conditions and charges stated on this website. Government/GSA fares are fully refundable.
Services
Services, Aircraft and Crew
The Carrier agrees to provide air transportation services ("Services"), as prescribed under the Terms and Conditions. The Carrier has sole operational responsibility for the Services and will ensure strict compliance with all applicable national and international regulations, rules, standards and practices.
The manner and means of performance of the Services will be within the Carrier's own discretion and control, unless otherwise agreed in writing.
Booking Conditions
We recommend that you take careful note of your Confirmation Number because you will need it to check in and for any queries. This will also be available to print online when booking through the website.
Please note that we can only check in the person named in the Confirmation.
We recommend that you reconfirm return flights within 48-72 hours prior to departure.
Both we and the Carrier reserve the right to refuse carriage to any person not complying with the booking requirements or any applicable law or license or of any contract or regulation made by the Carrier or any applicable agent or operator.
Conditions of Carriage
These are those requirements neccessary to comply with rules and regulations of the Carrier and or the agents and areas where passengers embark and disembark. This includes required identification items and equipment required in certain circumstances
Checking-in
When checking-in you WILL NEED Confirmation Number (where one has been issued), as well as valid photo proof of Identity. This will be limited to Common Access Cards (The government/DOD-issued military identification card, or CAC) issued by DoD/DoS, US Pasport, or Multi-National Force - Iraq (the card issued by the MNF-I or its sub-units) identification cards. Valid orders authorizing travel will be required for those traveling on CAC cards only, without a valid US Passport.
If you have not received your Confirmation number, or have lost it, please contact us via the website or one of our Travel Agencies.
Ages
As we primarily operate in elevated-threat environments, children under the age of 18 are not permitted except with prior advance notice and permission of the carrier.
Flight changes
Aircraft
We may occasionally have to change the type of aircraft used on a particular flight without advance warning. In such circumstances where the passenger has paid an additional seat supplement and such seat cannot be provided, then the passenger shall only be entitled to a refund of the supplement paid. We will endeavor to accommodate the passenger on the next available flight at no additional cost for the flight. Passenger retains responsibility for lodging.
Timetable
We undertake to use our best efforts to carry you and your baggage with reasonable dispatch. Times shown in the timetable and elsewhere are not guaranteed and form no part of this contract. Flight timings are subject to change without notice. We will inform you of any significant changes as soon as we become aware of such change.
We therefore recommend that you confirm your departure time a few days prior to your departure date on this web site by reviewing our Timetable. We assume no responsibility for making connections.
Routings
There may be a touchdown and/or aircraft change en-route to your final destination. Please check your flight routing information at time of booking.
Insurance
Adequate travel insurance cover is strongly recommended.
Customs Requirements
Passports & visas
Please ensure your passport and any necessary visas are valid for your complete trip and that the name on your passport matches the name on your Confirmation. If you fail to do so, you may not be accepted for a flight, and you will be solely responsible for any cost, loss or damage. Depending on your nationality, visas may be required for entry into certain destination countries and it is your responsibility to check whether you require a visa to travel. We are not responsible for your compliance with travel regulations.
Obligation to Declare Cash/Funds to Customs
Passengers carrying large sums of money are responsible for filing all necessary customs declarations. Undeclared funds may be subject to seisure by customs authorities.
Air Carrier Liability for passengers and their baggage
Passenger delays
The maximum liability, if any, for passenger delay is limited to the equivalent of the flight paid. Gryphon Holdings will not be responsible for delays due to bad weather, security reasons, or a passenger's late arrival to the check-in area. Gryphon will assist passengers who have missed a connection only if the delay is due to our own technical reasons.
Baggage delays
The maximum liability for baggage delay is limited to $100 per bag.
Destruction, loss or damage to baggage
The maximum liability for destruction, loss or damage to baggage up to $100 per checked bag. In the case of unchecked luggage the carrier is liable only if at fault.
Higher limits for baggage
A passenger can benefit from a higher liability limit by making a special declaration prior to check-in and by paying a supplemental fee.
Complaints on baggage
If the baggage is delayed, damaged, delayed, lost or destroyed, the passenger must notify us in writing within five calendar days of the flight landing.
Liability of contracting and actual carrier
If the Carrier is actually performing the flight is not the same as the contracting carrier, the passenger has the right to address a complaint or to make a claim for the damages against either. If the name or the code of an air carrier is indicated on the ticket, that air carrier is the contracting air carrier.
Weapons, ammunition and Protective Gear
Weapons are permitted in Checked Baggage and must be declared. Weapons must be stored and locked according to EU and US carriage rules for weapons, which include the weapon being unloaded, no magazine, placed in a locked, hard-sided container, and ammunition placed in a separate location. Weapons are subject to inspection and verification at any time. Ammunition is limited to 8lbs or less, in FACTORY configuration and container.
Protective Gear (IBA) may be carried on or worn by the passenger when entering or leaving the country.
Force Majeure
If the Carrier is rendered unable by Force Majeure to carry out its obligations under this Agreement, either wholly or in part, such party shall be entitled to cancel, with such notice to the other party as is reasonable under the circumstances, any and all flights affected by such Force Majeure without being subject to or responsible for any penalties or damages for such cancellation (the "Canceling Party"). Furthermore, the obligations of Canceling Party, so far as they are affected by the Force Majeure, shall be suspended during the continuance of the Force Majeure. "Force Majeure" means acts of God, war (whether declared or not), invasion, revolution, insurrection, or other acts of a similar nature or force, and shall include such time as when the pilot or crew of the Carrier determine that there is a clear and present danger to the passengers, crew, or aircraft.. Force Majuere shall also include governmental regulatory authorizations and approvals over which Carrier has no control.
The parties recognize that the services under this Agreement may be performed under harsh or hostile conditions caused by civil unrest. If the pilot or crew of any of the Carrier's aircraft reasonably determines that a clear and present danger exists to the life or property of any passenger or crewmember and cancels such flight or lands the aircraft at an alternate destination. Upon landing at aforesaid alternate destination the fee to Carrier shall be deemed earned.
